According to the sub-channel distribution method disclosed by the invention, the conflict threshold value is combined with an effective throughput capacity; sub-channels with the minimum quantity meeting self data requirements are selected according to the size of a sending data packet of each sub-channel and an idle possibility distribution parameter, so that more secondary users send out data, the conflict possibility of the main user is reduced, the effective throughput capacity of a network is increased, and the stability of a cognitive OFDM (Orthogonal Frequency Division Multiplexing) network is kept.
